Privacy Policy for Applicants

1. Introduction and Scope

This Privacy Notice explains how Swiss Helicopter Group AG (hereinafter referred to as “we”, “us”, or “our”) processes your personal data during the recruitment process. It applies to individuals applying for a position with us.

We process your personal data in accordance with the Swiss Code of Obligations (CO), the Swiss Federal Act on Data Protection of 25 September 2020 (FADP), the Ordinance to the Federal Act on Data Protection (OFADP), and other applicable data protection laws. We take the protection of your personal data seriously and treat it confidentially and in accordance with the applicable legal data protection requirements.

2. Legal Basis

We process your personal data on the basis of:

  • Art. 328b CO: Processing of data relating to an individual’s suitability for the employment relationship or required for the performance of the employment contract.
  • Federal Act on Data Protection: General principles governing the processing of personal data (Arts. 6–8 FADP)
  • Legal obligations: Social security law, tax law, employment law, etc.

3. Data Controller

The data controller within the meaning of the Swiss Federal Act on Data Protection is Swiss Helicopter Group AG, Hartbertstrasse 11, 7000 Chur, Switzerland. Although we are not legally required to appoint a Data Protection Advisor, we are available to assist you with all data protection matters.

4. Processing of Personal Data During the Recruitment Process

4.1 Categories of Personal Data Processed

As part of the recruitment process, we process the personal data you provide in connection with your application. This primarily includes your contact details, such as your name, address, email address, and telephone number. We also process information relating to your qualifications, including your curriculum vitae (CV), educational certificates, employment references, certificates, and any other application-related documents. Where you provide such information, we also process details of previous employers, referees, and your salary expectations. In certain cases, particularly for positions requiring a high level of trust, we may, with your explicit consent or where permitted by law, obtain criminal record extracts or debt enforcement register extracts.

4.2 Purpose of Processing and Legal Basis

We process your application data solely for the purpose of conducting the recruitment process and selecting suitable candidates. Such processing is based on Art. 328b CO in conjunction with the FADP, as the data directly relates to your suitability for the intended employment relationship. Where your consent is required for specific processing activities, we will obtain it separately. You are under no obligation to provide your consent; however, refusing to do so may result in us being unable to consider your application, or to consider it in full.

4.3 Retention and Deletion of Application Data

If your application is unsuccessful, we will generally delete your application documents within six months after completion of the recruitment process, unless statutory retention obligations require otherwise. With your explicit consent, we may retain your data in our applicant pool (talent pool) for a maximum of two years and contact you regarding future job opportunities. You may withdraw your consent at any time without providing reasons and without suffering any disadvantage.

5. Disclosure of Personal Data

As a general rule, your personal data will not be disclosed to third parties unless such disclosure is necessary for the performance of the recruitment or employment relationship, you have provided your consent, or we are legally obliged to do so. Personal data may also be shared with external service providers supporting us in the provision of our services, including IT service providers, recruitment agencies, and legal advisors. These service providers are contractually obliged to treat your data as strictly confidential and to process it solely for the agreed purposes. For the administration of recruitment processes, we use the e-recruiting solution provided by Ostendis AG, 5706 Boniswil, Switzerland. Ostendis processes applicant data on our behalf in accordance with the applicable legal and contractual requirements.

We do not disclose information to colleagues, family members, or creditors without your consent or a legal obligation.

Your personal data will only be transferred to countries outside Switzerland where the respective country provides an adequate level of data protection as recognised by the Swiss Federal Data Protection and Information Commissioner (FDPIC), or where appropriate safeguards, such as Standard Contractual Clauses, have been implemented. If we engage service providers located outside Switzerland, the EEA, or the EU, we will provide information about the safeguards in place upon request.

6. Data Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, destruction, alteration, or unlawful disclosure. These measures include, among others, access controls, encryption, regular security reviews, and training of our employees in data protection and information security. In the event of a personal data breach likely to result in a high risk to your rights and freedoms, we will inform you without undue delay where required by law.

7. Rights of Data Subjects

Under Swiss data protection law, you have various rights regarding your personal data. You have the right to obtain information about the personal data we hold about you and to receive a copy of such data. You may also request the correction of inaccurate personal data or the completion of incomplete personal data. Where the legal requirements are met, you have the right to request the deletion of your personal data and to object to the processing of your data. In certain circumstances, you may also request the restriction of processing or the transfer of your data to another controller. Where processing is based on your consent, you may withdraw that consent at any time without giving reasons. Such withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal.

We will respond to your request within 30 days unless exceptional circumstances require a longer processing period. In such cases, we will inform you accordingly at an early stage. If you are dissatisfied with our response or believe that your rights have not been adequately respected, you have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, Switzerland.

8. Amendments to this Privacy Notice

We reserve the right to amend this Privacy Notice at any time, in particular to reflect changes in legal requirements or new processing activities. The current version is available here. We will actively inform you of any material changes, for example by email. We recommend that you review this Privacy Notice regularly to remain informed of the latest version.
